Your privacy is important to us. This Privacy Policy explains how EverAway LLC (“we,” “our,” or “us”) collects, uses, discloses, and protects your personal information when you access or use our mobile application (the “Platform”), whether as a Homeowner or Home Watcher. Homeowners are users that are seeking home watch services and Home Watchers are users offering professional property-related services as independent contractors.
By using the Platform, you acknowledge that you have read, understood, and consent to be bound by this Privacy Policy.
IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY OR OUR PRACTICES, YOU MAY NOT USE OUR PLATFORM. THIS PRIVACY POLICY MAY CHANGE FROM TIME TO TIME AND YOUR CONTINUED USE OF OUR PLATFORM CONSTITUTES YOUR ACCEPTANCE OF THOSE CHANGES. WE ENCOURAGE YOU TO REVIEW THIS PRIVACY POLICY PERIODICALLY.
1. Information We Collect.
We collect the following categories of information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual (“personal information”):
- Contact Information: full name, email address, phone number, profile photo (if you choose to provide it), Homeowner property details (address, access notes- including security and alarm codes you provide), and Home Watcher driver’s license or state identification card.
- Professional or employment-related information: Current and past places of employment, position, work history, resume, and other related data
- Financial and Payment Data: payment card information (processed by a third party on our behalf but not stored by us), and bank account details (for disbursement only).
- Location Data: real-time GPS data for visit verification, routing, and check-ins.
- Media and Reports: photographs and videos captured during visits, live video feed for one-way check-ins, and generated reports with timestamps and metadata relating to home stays.
- Internet, Device, and Usage Data: IP address, device type, OS version, Platform activity (visit history, click patterns, service usage), log files for crash reporting and debugging.
We collect most of this personal information directly from you through our Platform. However, we may also collect information automatically through your access and use of our Platform. The personal information that we collect depends on the context of your interactions with us and our Platform, the choices you make, and the features you use.
This personal information is required to provide Platform to you. If you do not provide personal information when we ask for, it may delay or prevent us from providing our Platform to you. All
personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.
2. Cookies and Tracking Technologies.
Cookies: Cookies are small text files of information stored by the Internet browser on your device’s hard drive. We may use cookies or similar technologies for performance monitoring, crash reporting, usage analytics, and preference storage. We do not use tracking technologies for ad targeting or third-party marketing.
There are a number of different types of cookies, however, our Platform uses:
- Essential – These cookies are necessary to the core functionality of our Platform and some of its features, such as access to secure areas.
- Performance and Functionality – These cookies are used to enhance the performance and functionality of our Platform. For example, we may use these cookies so that we recognize you on our Platform and remember your previously selected preferences. These could include your geographic location. These cookies are nonessential to the use of our Platform, however, without these cookies, certain functionality may become unavailable. A mix of first-party and third-party cookies are used.
- Analytics and Customization – We uses these cookies and technologies to analyze how the Platform is accessed, used, or performing in order to improve your user experience and to maintain, operate and continually improve the Platform.
SDKs: An SDK (Software Development Kit) is a collection of tools, libraries, documentation, and code samples which EverAway uses to help EverAway build applications for specific platforms (e.g., iOS, Android, Windows) more efficiently.
3. Do Not Track
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature signal setting you can activate to signal your privacy preference about your online browsing activities. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signal.
4. How We Use Your Information.
We only collect and use your personal information if we have a proper reason for doing so, e.g.:
- To comply with our legal and regulatory obligations;
- For the performance of our contract with you or to take steps at your request before entering into a contract;
- For our legitimate interests or those of a third party; or
- Where you have given consent
A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.
In particular, we use your personal information to:
- Provide and manage Platform functionality;
- Facilitate service bookings and home watching assignments;
- Process payments and disbursements securely;
- Conduct identity verification and background screening;
- Prevent and detect fraud against you or us;
- Deliver real-time notifications and alerts;
- Improve the user experience through analytics and performance monitoring;
- Ensure business policies are adhered to, e.g. our Terms and Conditions of Use and other policies covering security and internet use;
- Perform statistical analysis to help us manage our business, e.g. in relation to our financial performance, customer base, offering range or other efficiency measures
- Ensure safe working practices, staff administration and assessments;
- Prevent unauthorized access and modifications to systems, including the Platform;
- Update and enhance customer records;
- Comply with professional, legal, and regulatory obligations that apply to our business;
- Communicate between users and with our support service via our internal messaging system;
- Publish and/or respond to request by Homeowners for Home Watchers;
- Support engagement and transparency within the Platform community, including by posting aggregated earning totals on leaderboards or recognition views in Home Watchers only features on the Platform;
- Receive our technical emails (e.g., password changes, etc.) that are essential to the proper functioning of our Platform;
- Establish a user score reflecting non-compliant or improper behavior and our legitimate interest in monitoring misuse of our Platform; and
- Marketing our services to:
- Marketing our services [and those of selected third parties] to:
- existing and former customers;
- third parties who have previously expressed an interest in our services;
- third parties with whom we have had no previous dealings.
We may also anonymize, aggregate or de-identify personal information so the end-product does not identify you or any other individual. Such aggregated, anonymized or de-identified information is not considered personal information for purposes of this Privacy Policy and we may use it for any purpose, including for marketing purposes. For example, we may use this information to generate norms by industry, geography, level, etc., enable us to understand where our services are being utilized, conduct ongoing validation studies, compile reports, and improve the services.
5. Sharing and Disclosure of Information.
We may share your personal information with:
- Other Users. We share certain personal information with other uses of the Platform in connection with publishing and/or responding to requests for Home Watchers and general communications between users. We also permit Home Watchers, in a Home Watchers only feature of the Platform, to view your first name, profile photo (if provided), and aggregated earnings totals (including all-time, monthly, or weekly amounts). Such information will be visible only to other Home Watchers within the Platform and is not accessible to Homeowners or the general public;
- Service Providers. We disclose your personal information third parties that provide business, professional, or technical support services to us and/or administer activities on our behalf, such as for payment processing, video streaming, background checks, and hosting. We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. This currently includes Stripe for payment processing, Twilio to facilitate the sharing of videos, photos, and live communications, and Checkr for background checks of Home Watchers;
- Analytics Providers. We disclose your personal information to parties that assist us in performing analytics and help us measure the effectiveness of the Platform.
- Governmental and Public Authorities. We disclose your personal information to government and public authorities, including law enforcement as necessary or permitted by the laws of any jurisdiction in which we operate, including in response to a subpoena, court order, investigative demand, request for cooperation from a law enforcement agency, or similar request from a self-regulatory body or government agency;
- Platform administrators. We provide your personal information to our Platform Administrators to view user profiles, reports, and visit records for operational purposes. All third parties are contractually obligated to maintain data confidentiality and security;
- Relevant Third Parties in Connection with a Business Transaction. We may disclose or otherwise transfer your personal information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction as well as in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
We may also need to share some personal information with other parties to the extent we believe it is necessary or appropriate to (1) protect our operations and those of our affiliates and subsidiaries; (2) investigate and prevent against fraud and other illegal activity; (3) protect our rights, privacy, safety, property, and/or those of others; or (4) allow us to pursue available remedies or limit damages that we may sustain.
We may disclose your personal information for other reasons described at the time of information collection or prior to disclosing your information. Additionally, we may disclose your personal information with your consent or when you direct us to do so.
Except as set forth above, we will not share your personal information with any other third party.
6. Retention
We will keep your personal information while you have an account with us or while we are providing our Platform to you. Thereafter, we will keep your personal information for as long as is necessary:
- To respond to any questions, complaints or claims made by you or on your behalf;
- To show that we treated you fairly;
- To improve our security or detect and prevent fraud; or
- To comply with legal or regulatory obligations or to keep records required by law.
We will not retain your personal information for longer than necessary for the purposes set out in this Privacy Policy. Different retention periods apply for different types of personal information. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of personal information; the potential risk from unauthorized use or disclosure of the personal information; the purpose(s) for which we use or may use the personal information; whether we can achieve the purpose(s) through other means; and the applicable legal requirements.

We use reasonable and appropriate physical, technical, and administrative safeguards to protect your information from unauthorized use, access, loss, misuse, alteration, or destruction. 8. Children’s Privacy.
Our Platform is not directed to children and you may not use our Platform if you are under the age of 18. If you are under 18, do not access or use our Platform or provide any information about yourself including, without limitation, your name, address, email address or any screen name or user name you may use. We do not knowingly collect personal information from individuals under the age of 18. If we become aware of such collection, we will take immediate steps to delete the data. 9. International Users.
We are headquartered in the United State of America (“U.S.”) and utilizes service providers in the
U.S. and around the world. Our Platform is hosted in the U.S. The Platform is not intended for users outside the U.S. If you are a non-U.S. user of the Platform, by accessing the Platform from outside the U.S. and providing us with data, you acknowledge and agree that your personal information may be processed for the purposes identified in this Privacy Policy. If you choose to access our Platform outside the U.S., you consent to the transfer to and processing of your data in jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction, including transfer to and processing of your data in the U.S. In particular, you are advised that the
U.S. uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation. Where the laws of your country allow you to do so, by using the Platform or the services or by providing your data, you consent and authorize us and our service providers to transfer, store, and use all such personal information in the U.S. (and any other country where we operate) and to the processing of that personal information by us on our servers located in the U.S., as described in this Privacy Policy. If you do not want your personal information transferred to the U.S. and any other country where we operate, please do not submit any information to us or use our Platform.

If, in your interactions with the Platform, you are linked or directed to, or click on, a third party website, we cannot control what information you may provide to that party or on that website, and we are not responsible for how that party may use or disclose any information you may provide to them. This is not as an endorsement by us of any third party website, content that may be offered on such third party website, or of any products or services provided by such third party. We do not control, nor are we responsible for, such third party website, product or service offerings. As such, we urge that you exercise caution before providing them with your personal information and to review the third party’s privacy policy for information on its data processing practice.
